These terms of use govern your use of the Loeb Smith website. Please note that our privacy policy forms part of our terms of use.

Any reference herein to “Loeb Smith” or “we” or “our” is a collective reference to Loeb Smith Attorneys (Cayman) which carries on business in the Cayman Islands as a corporate law firm, Loeb Smith Attorneys (Hong Kong) which carries on business in Hong Kong as a foreign registered law firm, and Loeb Smith (BVI) Ltd., which carries on business in the British Virgin Islands as a corporate law firm.  Our website is owned and operated by Loeb Smith Attorneys (Cayman), for its own benefit and for the benefit of all members of the Loeb Smith group.

This website, and all of the material within it is for general information purposes only. 8. Jurisdiction and law

Whilst our website will have content relating to our practice of the laws of the Cayman Islands and the laws of the British Virgin Islands, these  terms of use shall be governed by and interpreted in accordance with the laws of the Cayman Islands and subject to clause 9 below, you agree to submit to the exclusive jurisdiction of the courts of the Cayman Islands in respect of any disputes which may arise in relation to our website.

9. Arbitration and Waiver of Legal Proceedings

Any claim, dispute and controversy arising out of or in connection with these terms of use may, at Loeb Smith’s sole option, be referred to and finally resolved by arbitration under the LCIA Rules (London Court of International Arbitration Rules), which Rules are deemed to be incorporated by reference into this clause. Judgment on the award(s) rendered by the arbitrator may be entered in any court having jurisdiction thereof. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be the Cayman Islands. The language to be used in the arbitral proceedings shall be English. If a court action has been initiated by you at the time that Loeb Smith chooses to submit the matter to arbitration, then it is agreed that such court action is to be discontinued, unless the arbitrator finds that Loeb Smith has waived such right by substantially participating in the court action without having raised its right under this clause.
